Enforcement of your Judgment of Possession & Warrant of Eviction
After your Nassau County eviction proceeding is concluded, you most likely will receive a judgment of possession and a warrant of eviction, and potentially a money judgment if your tenant owed you back rent.
The next step after court is to take your judgment and warrant to the Nassau County Sheriff’s office Mineola Unit within the required timeframe so they can execute the warrant and get you back physical possession of your apartment. Only the Nassau County Sheriff’s Office can physically remove your tenant from the premises.
14-Day Notice
Once the Nassau County Sheriff’s Office receives your request to physically remove your tenant, their first action is to serve your tenant with a 14-day eviction notice. This notice will inform the tenant that they have 14 days to move out. This notice also informs the tenant that if they fail to move out within 14 days, deputies from the Sheriff’s Office will return, and physically remove the tenant and all of their belongings.
The Nassau County Sheriff’s Office does charge a fee to serve this notice, similar to a process server fee, and the cost varies depending on the amount of tenants to be served, and the distance of the property from the Sheriff’s office.
Physical Removal of Your Tenant
After the expiration of your 14-day notice, the Nassau County Sheriff’s Office will return to the apartment and physically remove your tenant from the premises, along with all of their belongings. There is an additional fee for this as well, in addition to a storage requirement (see below).
Nassau County typically has a bit of a backlog. So after the 14-day notice is served, it may take several weeks until the Sheriff’s Office can return for the physical eviction. You can call the Nassau County Sheriff’s Office at the number above for the latest backlog status and timeframes.
Nassau County Storage Requirement
Nassau County requires all landlords to pay for storage for their tenant’s belongings for up to one month after a physical eviction. (In Suffolk County, the sheriffs simply remove the tenant’s belongings and leave it at the curb).

The Nassau County sheriff’s office will contact you to coordinate a move-out date. You or a locksmith should plan to be present to change the locks immediately.
Once the warrant has been executed and your tenant has been removed from the property, you will have legal possession of the premises again.
